Terms of Service

These terms govern your use of SquareWave.network (the "Service"). By using the Service or creating an account you agree to them. The Service is operated by Photon Consulting Limited, trading as SquareWave Studio, an Irish company registered with the Companies Registration Office under number 702545 (registered address: Ashbourne, Co. Meath, A84 D925, Ireland).

Accounts

You must be at least 16 to create an account. Keep your login secure; you are responsible for activity under your account. You can export your data and delete your account from your settings (see our Privacy Policy for what happens to your data).

Your content and the licence you grant us

You keep ownership of the patches, presets, samples, images and text you upload ("Your Content"). To run the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt (for example to generate waveforms and thumbnails), publish and distribute Your Content for the purpose of operating the Service and promoting it to potential users, including by displaying examples of content available on the Service on our own channels. You also pick a licence for downloaders (see Licensing); they must honour it. You confirm you have the rights to upload Your Content and to grant these licences.

Acceptable use

You agree not to upload, share or do anything that:

• infringes someone else's copyright, trademark or other rights;
• contains malware, or is not what it claims to be;
• is unlawful, harassing, hateful, or sexual content involving minors;
• impersonates another person or misrepresents your affiliation;
• is spam, or attempts to game rankings, downloads or follows;
• attempts to break, overload or probe the Service or its security.

Moderation and removal

We may remove content, limit visibility, or suspend or terminate accounts that breach these terms or our Community Guidelines, and we will give a statement of reasons where required. Reports of copyright infringement follow our copyright process.

Downloads and the apps

Downloads are provided as-is. Files are user-supplied and may be unofficial or untested on a given device; check device compatibility before use. We are not liable for any damage to your device, data loss or other harm resulting from installing or using user-supplied files. The PatchStudio apps are separate products with their own terms.

Paid packs

Our directory may link to creators' own stores on an affiliate basis. We are not the seller, we take no payment, and purchases, delivery and refunds are between you and that store. See the affiliate disclosure.

SquareWave Cloud subscription

SquareWave Cloud is an optional paid subscription that adds automatic backup, sync and extra storage for your tapes and projects. Billing is handled by our payment provider, LemonSqueezy, as merchant of record; prices are shown before you subscribe and include any applicable tax. You can change your plan or cancel at any time from your account, and cancelling stops future renewals while leaving access in place until the end of the period you have paid for.

If your subscription lapses or is cancelled, your account returns to the free plan. Your stored data is kept and stays available to download and restore; while you are over the free storage limit you cannot add new uploads until you are back under it or subscribe again. We do not delete your data when a subscription lapses. We keep lapsed data for at least 12 months, and if we ever introduce a policy to remove data after a period, we will give at least 60 days' notice by email and in the app before any data is removed.

Disclaimers and liability

The Service is provided "as is" without warranties. To the extent permitted by law we are not liable for indirect or consequential loss, or for user content. Nothing here limits liability that cannot be limited by law, and nothing in these terms affects your statutory rights as a consumer under Irish or EU law.

Changes and governing law

We may update these terms. We will give at least 30 days' notice, by email or on-site notice, before material changes take effect, and you may close your account before they apply if you do not accept them. These terms are governed by the laws of Ireland, and the Irish courts have jurisdiction. If you are a consumer, you may also bring proceedings in the courts of your country of residence, and nothing here removes the protection of the mandatory consumer law that applies there.
